BOARDING AGREEMENT (2009)

This Agreement is made this ___ day of ________, 20___, by and between:

Legends Three Pine Ranch & Australian Shepherds, L.L.C. (Steve & Anne Shope, owners), hereafter referred to as "Shopes"

and

(YOUR NAME{S}) , hereinafter "Owners"

WHEREAS Owners would like for the Shopes to board their dog(s) as more particularly described as follows:

WHEREAS, Shopes are agreeable to boarding the above-named dog(s),

THE PARTIES TO THIS AGREEMENT HEREBY AGREE AS FOLLOWS:

1. The dogs will be boarded beginning the ___ day of _________, 20__ and ending the ____ day of ___________, 20__ (hereinafter "period of boarding"). Expected arrival time at the boarding facility is _______________ am/pm.

2. Owners state: 1) The dog(s) are in good health, free of any communicable disease, and haven't come in contact with any communicable disease within the past thirty (30) days, 2) copy of rabies is attached for each dog boarded, 3) dog food and any additives are to be provided for by the Owner, and any special instructions are as set forth below: (Special instructions include housing preferences: crate, kennel, dog run, companions housed together, feeding times and quantity, commands understood, ...)

3. Owners hereby given permission to seek veterinary attention for their dog(s) as the Shopes deem necessary, to hold the Shopes harmless from injury, illness or death of the dog(s) while in the Shopes' care or Shopes' assigns (assigns, including but not limited to, their daughter Stephanie Shope-McDaniel or granddaughter Shelby Anne McDaniel). Shopes agree to make every good faith effort to contact Owners should veterinary care be required or should injury or illness occur.

4. Shopes disclose housing accomodations include: oversized crates, individual dog run inside a dog barn, individual dog runs protected from the elements located outside, and approximately one acre to two acre play areas sheep fenced. Shopes request any dogs being boarded during the months of April, May, June, July, August, September and October have had the rattler vaccine prior to being boarded. Shopes disclose they do periodically have rattlers on site at the ranch. Owners hereby disclose if their dog(s) are fence climbers or diggers, destructive in nature insofar as water or feed buckets, fencing, or are dog or people agressive or reserve in nature:

5. Owners agree to pay the following boarding fee: $25.00 deposit ("boarding fee deposit") due at the time boarding is contracted (this boarding fee deposit reserves a boarding period). This boarding fee deposit is non refundable and non transferable to another contracted boarding period. The boarding fee deposit is subtracted from the total boarding fee for the period of boarding named above. Shopes will board the dog(s) for: $12.50 per day per dog ("total boarding fee"). The total boarding fee is applicable from the day the dog(s) arrive until the day the dog(s) are picked up by the Owners. Failure to pick up the dogs within 48 hours of the end of the period of boarding period will result in a daily penalty fee of $10.00 per day per dog.

6. Shopes reserve the right to cancel any period of boarding for just cause. If no boarding takes place due to the Shopes' cancellation, the boarding fee deposit will be refunded.

7. Payment remitted by the Owners is acceptable cash or in check, money order or cashier's check made payable to "Legends." Insufficient funds will result in a handling and penalty fee of $35.00 payable to the Shopes. Shopes will use all means to collect, and costs to collect will be the responsibility of the Owners.

8. Any suit for breach of this Agreement shall be brought in the county and state of Shopes' residence.

By signature below, all parties to this Agreement agree to abide by all terms and conditions herein stated.
