TRAINING/HANDLING CONTRACT(updated 1/21/10)
This Training/Handling Contract (hereinafter "Contract") is by and between Steve and Anne Shope doing business as Legends Three Pine Ranch and Australian Shepherds LLC, their assigns and designees, (hereinafter "Shopes")

NOTE: All owners of the dog must sign this Contract. Please indicate which owner is assuming financial responsibility. In the event this owner defaults, the Fee, as further described below, shall be the responsibility of all the owners collectively. A late fee of $1.00 per day shall be applicable for each day the Fee, as further described below, is delinquent. Furthermore, a fee of $30 for insufficient funds is applicable.

NOTE: If there is more than one owner of Client's Dog, all owners MUST sign this Contract and/or furnish a Power of Attorney designation. Client must attach copy of registrations, shot record, and microchip information plus any special directives for each dog.
FOR THE VALUABLE CONSIDERATION SET FORTH BELOW, THE CLIENT AND THE SHOPES AGREE TO THE FOLLOWING TERMS AND CONDITIONS, AS EVIDENCED BY THEIR SIGNATURES BELOW:
1) The Client agrees to pay for the following services (mark as applicable) for the Fee designated below:
(Please note: ASCA primarly, often including travel to other states; AKC is done only in NM; AHBA is done only in NM)
THE FEE: The Fee is defined herein as: the monthly handling/training charge as marked below PLUS entry fees or travel fees, heartwormer, flea & tick protection, veterinary care and dog food or additives. NM gross receipts tax (7.4375%) is applicable for any dog coming from New Mexico. The Fee is due and payable on the 1st of each month. The Client will receive an email bill (or one via USPS) from the Shopes monthly recapping the Fee (fee is paid in advance for each month), which bill will reiterate the due date and monetary penalities for deliquency. The first monthly Fee (prorated as applicable) is due the day the Client's Dog arrives at the Shopes' and if applicable is prorated. The Fee is delinquent ten (10) days following the 1st of each month, and a penalty of $1/day will be due for each default day thereafter. Any insufficient check will result in an additional fee of $30.00 per incidence. The Client's Dog will not be returned to the Client until the Fee is brought current. Any suit for breach of this Contract shall be brought in the county and state of Shopes' residence. The party found to be in default will be responsible for all attorney costs. If the Fee is not brought current within 60 days of the delinquency, Shopes have permission to place the Client's dog as they deem appropriate. Placement of Client's Dog will be confidential, without disclosure to the Client. Only one fee is applicable for each month; you can mix and match according to your dog's needs and your travel plans. If sending more than one dog, you may take 20% off.

__$450/ANNE SHOPE/STEVE SHOPE (TRAINERS/HANDLERS) - (MONTHS APPLICABLE: _______________________________) { Anne will train your dog for stock work under Steve's supervision and direction - Steve will be handling/training only as his schedule permits but definitely will be involved, often handson in the training process - this is a joint stockdog training/handling effort on Steve's and Anne's part - please be advised that some dogs work better for a female than they do a male plus Steve has a heavy travel schedule for summer of 2010); Anne or her daughter, Stephanie Shope McDaniel, will train and handle your dog in conformation and/or obedience and/or rally if desired). DVD or Video or U-Tube feedback will be given once a month.

The Client understands that Client's Dog will be housed in a Dog Barn in an individual dog run or crated as applicable in an oversize crate. The Client's dog will exercise in outdoor runs or in large exercise areas. The Client's Dog will get housetime periodically.
2) Reiterating: All entry expenses into matches, trials or shows are solely the financial responsibility of the Client. All dog food and additives are solely the financial responsibility of the Client.
3) Any travel expenses to shows or trials outside of New Mexico are a standard fee of $150.00 per trip. There is no fee for travel expenses within New Mexico.
4) The Client understands that the Shopes do not guarantee titles will be earned by the Client's Dog. Shopes promise to disclose timely to the Client the progress, or lack thereof, in the Client's Dog's training abilities for the discipline contracted. Shopes will not enter the Client's Dog in any trials or shows without the expressed written permission of the Client (email, fax or USPS only). Shope hereby informs Client that some trials and/or shows require entry and payment come directly from the Client.
5) While this Contract is in full force and effect, the Client agrees to hold harmless the Shopes, their assigns, designees or heirs from any and all harm, injury, illness, or death of the Client's Dog.
6) The Client understands that the terrain and weather at the ranch and in trials or shows can be unpredictable and sometimes dangerous. The Client further understands that livestock at the ranch and in trials can be unpredictable and often dangerous. The Client understands there may be rattlers on site, and that Shopes recommend all dogs on site have had an annual rattler vaccination. The Client gives Shopes permission to give any first aid to the Client's Dog that the Shopes deem appropriate and applicable, and for the Shopes to seek any emergency veterinary services for the Client's Dog the Shopes' deem appropriate and applicable. The Client understands and concurs that all veterinary expenses and well care for the Client's Dog are solely the financial responsibility of the Client.
7) This Contract may not be amended or altered except in writing and signed by all parties. This Contract may be cancelled at any time upon one week's written (email, fax or USPS) notice to either party. Boarding and Training fees remain in full force until the Client's Dog is returned to the Client. All shipping or delivery charges in getting the Client's Dog to Shopes, or from Shopes to the Client are the Client's financial responsibility. Clients may stay in the Shope's guesthouse one night free when delivering their dog or picking up their dog, provided notice has been given and the guestroom is available. Dogs flown in to the the Shopes will fly into Albuquerque International Airport (one hour ten minutes from the ranch).
