DOGGY CAMP AGREEMENT

This Agreement is made in duplicate this ___ day of _________, ______ between STEVE D. SHOPE and ANNE M. SHOPE d/b/a LEGENDS THREE PINE RANCH AND AUSTRALIAN SHEPHERDS, LLC, their heirs and assigns, (hereinafter collectively "Shopes") and ___________________________________________________________________________________________________________________, their heirs and assigns, (hereinafter "attendee" whether singular or plural.
WHEREAS, Shope provides lessons for herding breeds in working/herding, obedience, rally, conformation, grooming and temperament problem solving at Legends Three Pine Ranch (hereinafter the "facility"), and
WHEREAS the attendee wishes to __ take lessons, attend __ stockdog or doggy camp, or __ instinct test at the Shopes facility,
IT IS THEREFORE AGREED AS FOLLOWS:
1. STOCKDOG (group or private) CAMP: A deposit of $100.00 (one hundred and no/100ths dollars) shall be remitted to Shope to hold the camp dates of:

and Shope, by signing and returning a copy of this Agreement to the Attendee, agrees to reserve those dates for the purposes of working with the Attendee and their dog(s). The Attendee will arrive at approximately ________ on the ___ day of __________, ________. The $100.00 deposit is non refundable unless the camp is canceled by the Shopes. The deposit must be received along with this Agreement for the booking dates to be reserved. Reiterating, no booking date or camp space is reserved without a deposit. Attendees are accepted on a first reserved & booked basis. Attendee must sign and return the enclosed Release with an original of this Agreement. NOTE: Once the Attendee's contract and reservation has been received and camp date(s) officially booked, there is a $25.00 charge for switching the reserved camp date to another camp date. Additionally, attendee is then subject to the current camp fee costs as of the date they attend camp minus their $100 deposit. For the above-stated $25 fee, the Attendee may roll a deposit to a new camp date only IF space is available. Rolling a deposit to a new camp date must occur within a one year period from the originally contracted camp date. After one year, the deposit is forfeited. FURTHER NOTE: If the camp deposit is paid via Paypal, a 4% fee must be included in the remittance of the deposit. Attendees are encouraged to save money by using the United States Postal Service for making the initial deposit.

Cost of the camp (camps are two or more attendees but not over six attendees)
Camp days are long - they begin early in the morning and end very late in the evening. Discussions are ongoing during breakfast, lunch & dinner. Video footage of you and your dog is often used for feedback and instructional purposes, in addition to other instructional materials as applicable. If your dog has soft pads, it is highly recommended you put boots or wraps on your dog on day one if doing stockwork.
We use more than one instructor and we will keep you very busy! Three arenas, round pen, sorting pens, post advanced trial course, ranch trial training - we cater to yours and your dog's individual needs. We also offer opportunity to problem-solve in obedience, conformation, and temperament issues. Our library is stocked with books, dvds, & videos so resources are readily on site for those of who would like to take time-out from the weather extremes outside or rest up from working your dogs. Our camps will definitely fill up your daytime, and you'll get your money's worth! We also will fill up your tummies with some downhome cooking. We aim to cater to yours and your dog's needs.

Dogs in the guesthouse MUST BE CRATED. They are not allowed to run loose. It is warm or cool enough here to leave your dogs in your crates in your vehicles if you desire to do so. You may exercise them in the designated pasture.

Water here is excellent for drinking. Bring bottled
water ONLY if you prefer to have it on hand. We will not be furnishing
bottled water. You may fill your camping trailer with water upon
arrival if you desire.
__ g. EXTRA DAYS OVER AND ABOVE ARRIVAL OR DEPARTURE DAY PRIOR TO OR FOLLOWING CAMP: Arrangements for extra days in the guesthouse prior to or following Doggy Camp are handled on a case-by-case basis as our time permits. In addition, you can request arrangements for us to board your dogs while you take a tour of any New Mexico sites at a cost of $5/dog per day - we have dogruns in which your dogs may reside. Guesthouse fee is $65/night double occupancy for non-doggy camp days and includes breakfast only. Camping fee remains the same. Dog runs are NOT available during Doggy Camp. You may book the guesthouse for a private lesson/tour of NM at the "Extra Days" fees.
___ Private Lesson. If you are in our neck of the woods and would like to drop in for a private lesson, these are $60/hour per person (no dog limit).
___ Instinct Testing Only Dogs will be tested on sheep two times and a certificate of the testing will be given to the Attendee. Instinct Testing is $40.00 per dog tested. If you have paid for camp, this testing is free of charge.

CAMPING ON SITE is directly across from the tennis court. Water is available to fill your holding tanks. Electric is available. There is no dumping allowed.

Shopes state that video training tapes, video feedback, observance of other dogs working, periodicals, and magazines all will be utilized in any training process at the facility so there will be times when the attendee's dog will need to be crated. Attendees may peruse the library and check out any material to read or watch as time allows. Attendees may video tape any portion of the doggy camp. Attendees are in charge of their video cameras and equipment, and hold harmless the Shopes from any loss or damage.
3. TEMPS/TERRAIN: Shope states the temperatures in Estancia are normally 10 degrees cooler than Albuquerque with a slight wind or brisk wind being normal. Shopes state there is no vet or doctor on site and none are on call. Terrain can be rough; periodically there are rattlers on site. Nearest doctor or hospital is one hour from the facility. We keep a first-aid kit on hand for both dogs and humans. Attendees are welcome to use the first aid kits at their sole discretion. We will provide attendees with a handout of local vets, doctors, and hospitals.
4. The attendee agrees to bring crates or covered portapens for dogs in attendance, to keep dogs reasonably quiet, and to pick up after themselves and the attending dogs. Dogs to attend camp, take private lessons, or to be tested are as follows:

Shopes request all dogs attending camp, taking private lessons or being instinct tested be healthy, up-to-date on shots, rabies be current, flea & tick protection be on the dog prior to arrival, buckle collar be used with a leash and also a pull tab is highly recommended. Pad protection for those dogs not accustomed to rough terrain is HIGHLY recommended. If possible, begin using Tuf Pad two weeks prior to attendance if your dog has soft pads; bring vet wrap, anticeptic salve and bandages in case your dog blows, cracks, or injures a pad. We keep medicine on hand for pads should you forget. Bring dog boots if you prefer. If your dog has soft pads, put the dog boots on the FIRST DAY - don't wait until your dog blows a pad to use the dog boots. Dogs must be under control at all times and liability will fall upon the dog owner for any actions or inactions resulting in injury, death, or illness to the dog or to the attendee. Any dog or human recently or concurrently being ill with a communicable disease or dog or person exposed to a communicable disease such that it would put our kennel or us in danger of getting this disease must not set foot at our facility. Attending or coming on site without disclosure can result in legal action as deemed appropriate and applicable.
5. Shopes state the altitude here is around 6,500 and sun protection is recommended for both handler and dog. The nights can be cool so a light jacket might be needed in the summer. Head covering and warm jackets are recommended for winter as we get a cold, brisk wind. We work in all kinds of weather so be prepared. Bring your mud boots.
6. If you are bringing your video camera, please bring cables for hooking your camera up to our TV; our hookups may not be compatible. Video feedback can be invaluable to both the attendee and the instructor. We encourage the use of such.
7. Full reimbursement
will be made ONLY if Shope cancels the scheduled camp. Payment in
full for camp is expected upon arrival and/or prior to departure. A statement will be given recapping all fees for your records. As stated deposits
are non-refundable if attendee is unable or unwilling to attend the scheduled
camp. Exceptions will be made on a case-by-case basis for serious illness or injury
and with adequate proof provided.
An insufficient check charge of $30.00 shall be applicable for any insufficient funds, plus any and all legal action necessary will be taken by Shope to collect at attendee's expense.
8. This Agreement shall be binding on all heirs and assigns of Shope and the attendee and may not be amended except in writing and signed by all parties hereto.

HOLD HARMLESS AGREEMENT
I, my assigns and my heirs by this my directive, agree to hold harmless Legends Three Pine Ranch and Australian Shepherds, LLC, Legends Three Pine Ranch, Legends Australian Shepherds, and Steve and Anne Shope (collectively referred to herein as "Legends"), its assigns and heirs, and any assigned instructors or assistants, from any injury or death to me or my dog or those in my charge, from loss of or injury to any personal possessions including any vehicle in my charge, from any illness or injury or damage incurred by me or to me or my dog while in attendance, participating in or observing any events, trials, practices, matches, lessons on the premises. Premises shall be defined as the 480 acres included in the Legends Three Pine Ranch. I understand my dog is my responsibility to keep in control at all times, quiet, crated or on lead when not in the arena or otherwise directed for a performance or conformation venue. I understand I am responsible for watering, feeding, and picking up after my dog. I further understand the terrain on the ranch can be rough, weather can be harsh at times, and insects and poisonous snakes are present and I hold harmless Legends should any injury or bite occur on the Premises to either me or my dog or those in attendance with me. I also understand no vet or doctor will be present and time could be of the essence in getting me or my dog or those in attendance with me to a vet or doctor for an injury, illness, or bite and I agree to hold harmless Legends for any first-aid and should qualified medical attention not be given timely, appropriately or adequately. I understand stock, fencing and terrain can be unpredictable and I take full responsibility for any action or inaction on my dog's or my part for any subsequent injury that might occur to me or my dog or those in attendance with me as a result of participating in herding/working, obedience, conformation, agility, tracking, or any other venue held on the Premises. I take full responsibility and hold Legends harmless for my dog's actions or inactions at all times, any other dogs' actions or inactions which are brought on site by me or my relatives or friends, any actions or inactions of my relatives or my friends in attendance with me.
